Coal Mining Search | A Conveyancing Guide

During the conveyancing process your conveyancing solicitor may decide you need a Coal Search on the property you are buying. A coal search is required if you are buying a property in an area where coal mining used to take place and will identify if there is an environmental or stability risk arising from past, current and future coal mining activity. The report will include information on mineshafts, subsidence claims, reported hazards and mine gas emissions.

Why do I need a Coal Search?

Your conveyancing lawyer will request a coal search if you are buying in a coal mining area.

Affected areas include:-

  • Large parts of South Wales including Swansea
  • Small parts of South England such as Bristol and East Kent
  • Parts of the midlands including areas surrounding Birmingham and Coventry.
  • Large parts of North England such as Stoke-on-Trent, Nottingham, Sheffield, Manchester, Chester, Leeds, Bradford, the Yorkshire Dales, Newcastle and Durham.

You can use this map made by The Coal Authority to see whether you are likely to need a Coal Search on the property you are buying.

If you are getting a mortgage and you are buying in an area with a history of coal mining your lender will want you to have a Coal Search carried out and may not release funds without one. If you are not getting a mortgage your conveyancing solicitor will strongly recommend you have a Coal Search as the results could affect your decision to buy the property, however, you do not have to one. Your conveyancing lawyer will discuss your options with you so you can make an informed decision.

What happens during a Coal Search?

When your conveyancing lawyer receives the sale contract from your seller’s conveyancing solicitor they will decide what searches need to be conducted on the property you are buying. If your conveyancing lawyer decides you need a Coal Search they will submit a request to The Coal Authority on your behalf. The Coal Authority will then run a search on the property (please note this is not a physical search) and send a report to your solicitor. Your solicitor will then offer you advice based on the information contained within the report.

What is a Brine Search?

A Coal Search is sometimes combined with a Brine Search. A Brine Search is used to find out whether the property could have structural damage caused by brine seeping into the property. This can happen as a result of brine pumping or mining activities, which is why a Coal Search and Brine Search are often combined.

A Brine Search is sometimes referred to as a “Cheshire Brine Search”, because they are often needed when buying property in Cheshire and in some parts of Greater Manchester. If you need a Brine Search In-Deed’s search provider will submit a search to the Cheshire Brine Compensation Board to see whether the property has been affected by this.
